These Terms and Conditions (“Terms”) govern your use of canopyclimatesystems.com and any purchase, inquiry, or other interaction with Canopy Climate Systems. This website and the Canopy Climate Systems brand are operated by Skana Engineering LLC (“Canopy Climate Systems,” “we,” “us,” or “our”).
By using this website, submitting information, requesting a quote, or placing an order, you agree to these Terms. If you do not agree, please do not use the website or purchase our products.

ELIGIBILITY
You must be at least 18 years old or have the involvement and permission of a parent or legal guardian to place an order or enter into an agreement with Canopy Climate Systems.
WEBSITE USE
You may use this website only for lawful personal or business purposes. You may not:
• Interfere with the operation or security of the website.
• Attempt to gain unauthorized access to the website, customer accounts, or connected systems.
• Introduce malicious code, automated scraping tools, or other harmful technology.
• Use website content, product information, photographs, designs, or branding in a misleading, infringing, or unauthorized manner.
• Use our products or services for an unlawful purpose.
We may restrict or terminate access to the website when reasonably necessary to protect our customers, business, intellectual property, or systems.
PRODUCT INFORMATION
We make reasonable efforts to present accurate product descriptions, compatibility information, photographs, prices, and availability. Because products are manufactured and improved over time, minor variations in appearance, materials, component placement, or construction may occur without affecting the product’s intended performance.
Product photographs may include enclosures, plants, animals, reservoirs, decorations, or other items for demonstration purposes. Only the items specifically identified as included in the product description are included with a purchase.
Prices are listed in United States dollars unless stated otherwise. We may correct typographical, pricing, or product-information errors. If an error materially affects an order you have already placed, we will contact you and allow you to confirm the corrected order or cancel it for a full refund.
ORDERS & PAYMENT
Submitting an order represents an offer to purchase the selected product. An order is accepted when Canopy Climate Systems confirms it and payment is successfully authorized.
We may decline or cancel an order because of suspected fraud, payment failure, pricing or listing errors, product unavailability, shipping restrictions, or circumstances that prevent us from completing the order. If we cancel an order after payment has been collected, the amount collected will be refunded to the original payment method.
Payments are processed through third-party payment providers. Your use of a payment method may also be subject to the provider’s terms and privacy practices.
Customers are responsible for providing current, complete, and accurate billing, shipping, and contact information.
BUILT-TO-ORDER PRODUCTS
Canopy systems are built to order. Production and delivery dates are estimates rather than guaranteed completion dates. Current production estimates are displayed on the applicable product page and in our Shipping, Returns & Warranty Policy.
If we become unable to ship within the stated or subsequently agreed timeframe, we will contact you with available options, which may include consenting to a revised timeframe or canceling the affected order for a refund as required by applicable law.
CUSTOM CANOPY PROJECTS
Custom Canopy requests are evaluated individually. Submitting a request does not require Canopy Climate Systems to accept the project and does not create a design, manufacturing, or delivery obligation.
The project scope, compatibility, price, estimated schedule, deposit requirements, included revisions, and other project-specific terms will be identified in a written quote or project agreement. If a written quote or project agreement conflicts with these general Terms, the project-specific document controls for that project.
Once approved design, material purchasing, or fabrication has begun, deposits, design fees, materials, and completed labor may become nonrefundable as explained in the applicable quote and our Shipping, Returns & Warranty Policy.
SHIPPING, RETURNS & WARRANTY
Production, shipping, delivery, order changes, cancellations, returns, shipping-damage claims, and Lifetime Limited Warranty coverage are governed by our Shipping, Returns & Warranty Policy at:

PRODUCT INSTALLATION & RESPONSIBLE USE
Customers are responsible for confirming product compatibility and following all installation, operating, cleaning, and maintenance instructions.
The Verdant 18 is designed for the compatible enclosure identified on its product page. Do not install or operate a Canopy system on an incompatible, structurally damaged, or improperly assembled enclosure.
Canopy systems are intended for normal indoor use. Keep electrical connections and components protected from unintended water exposure. Do not operate a product with damaged wiring, connectors, housings, or other electrical components.
Canopy systems assist with environmental management but do not replace regular observation, independent verification of enclosure conditions, or responsible animal and plant care. Environmental requirements vary by species, enclosure, location, and setup. Customers remain responsible for selecting appropriate settings and monitoring their animals, plants, enclosure, water supply, and surrounding property.
Information provided through the website, product materials, or customer support is general product guidance and is not veterinary, medical, or professional animal-care advice.
CUSTOMER ACCOUNTS
If you create a customer account, you are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account. Notify us promptly if you believe your account has been accessed without authorization.
INTELLECTUAL PROPERTY
The website and its contents—including the Canopy Climate Systems name and branding, text, photographs, graphics, product designs, software, firmware, control logic, documentation, drawings, and other materials—are owned by or licensed to Skana Engineering LLC and are protected by applicable intellectual-property laws.
Certain Canopy Climate Systems technologies or designs may be patent pending. Nothing on this website grants permission to copy, reproduce, reverse engineer, manufacture, distribute, publish, or commercially exploit our intellectual property without prior written authorization.
Purchasing a product transfers ownership of the physical product only. It does not transfer ownership of any underlying design, firmware, software, documentation, manufacturing method, or other intellectual property.
Unless a written Custom Canopy agreement states otherwise, Skana Engineering LLC retains ownership of the engineering methods, reusable design elements, drawings, software, control systems, and other intellectual property developed while completing a custom project.
CUSTOMER SUBMISSIONS
You retain ownership of photographs, text, specifications, and other original materials you submit. You grant Canopy Climate Systems permission to use those materials only as reasonably necessary to respond to your inquiry, evaluate compatibility, prepare a quote, complete an approved project, provide support, or fulfill legal obligations.
Do not submit confidential or proprietary information through the general website forms unless confidentiality has been established through a separate written agreement.
THIRD-PARTY SERVICES & LINKS
The website may use or link to services operated by third parties, including Squarespace, payment processors, shipping carriers, social platforms, and external websites. Those services may be governed by separate terms and privacy policies.
We are not responsible for the availability, security, accuracy, or content of third-party websites or services that we do not control.
WEBSITE AVAILABILITY
We work to keep the website accurate, secure, and available, but uninterrupted or error-free access cannot be guaranteed. We may modify, suspend, or discontinue website features when necessary for maintenance, security, business operations, or improvements.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, Canopy Climate Systems and Skana Engineering LLC will not be liable for indirect, incidental, special, or consequential damages arising from the use of this website or our products, including loss of data, revenue, animals, plants, or surrounding property.
For claims relating to a purchased product, our responsibility will be governed by the remedies described in the applicable Shipping, Returns & Warranty Policy and any rights provided by law.
These limitations do not exclude or restrict liability or consumer rights that cannot legally be excluded or restricted. Some jurisdictions do not allow certain liability limitations, so some of these provisions may not apply to you.
ELECTRONIC COMMUNICATIONS
By contacting us or placing an order, you consent to receive communications relating to your inquiry, quote, purchase, shipping, support request, or warranty claim electronically.
Marketing emails are optional, and you may unsubscribe from them at any time. Unsubscribing from marketing does not prevent necessary transactional or support communications.

GOVERNING LAW
These Terms are governed by the laws of the State of Montana, without regard to conflict-of-law principles, except where the laws of another jurisdiction must apply.
Any legal proceeding relating to these Terms or our products will be brought in a court with jurisdiction in Gallatin County, Montana, unless applicable consumer law gives you the right to bring a claim elsewhere.
SEVERABILITY
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. The unenforceable provision will be interpreted or modified only to the minimum extent necessary to make it enforceable where permitted by law.
CHANGES TO THESE TERMS
We may update these Terms as our website, products, or business practices change. Updated Terms will be posted on this page with a revised date.
Changes will apply prospectively and will not reduce warranty coverage or materially alter the terms of an order already accepted unless you agree to the change or the change is required by law.
